What is Advocates Paying Advocates' Intellectual Property Policy?
We take matters of intellectual property infringement very seriously. It's important to us that all of our community members follow our rules and respect the intellectual property rights of others.
As an Advocates Paying Advocates Seller, everything you post on our Marketplace should fall into one of the following categories:
- An original resource that contains only content that you've created yourself (imagery, text, video, and everything else).
- An original resource that contains content you didn't create but that you have the right to use (for example through a license for commercial use, explicit authorization from the creator, public domain content, or because of a fair use exception).
If we receive notice that a Seller has violated this rule by posting a resource that infringes on someone else's intellectual property rights, we remove that resource from our site and that Seller risks having their account closed.

Copyright & Trademark Policies
At Advocates Paying Advocates, we respect the intellectual property rights of others, and we ask that our users do the same. We've established the following intellectual property infringement policy in accordance with the Digital Millennium Copyright Act ("DMCA") and other applicable laws.
If we receive a valid infringement notice from a copyright or trademark owner that meets all of the requirements listed below, we comply with the law and remove the content from our site. As a service provider hosting content produced by our community, Advocates Paying Advocates isn't in a position to make legal judgment calls or resource comparisons, so we often have to rely on formal notices to take action.
Before You Get Started...
Here are some general definitions that you may find helpful:
- Intellectual Property is an umbrella term that encompasses trademark, copyrights, and patents. This policy covers copyrights and trademarks.
- Copyright refers to the rights of a creator or author of a unique piece of work to protect against copying, display, reproduction, creation of derivative pieces, and so on.
- Trademark refers to a word, phrase, logo, or design used to identify a particular brand as distinct from other brands or products.
Notice and Takedown Process
We work hard to respond as quickly as we can to complete notices of alleged copyright or trademark infringement. As required by law, we've assigned a Designated Agent to receive infringement claims.
If you believe that your work has been used in a way that constitutes copyright or trademark infringement in material found on our Marketplace, please submit a notice to our Designated Agent. To comply with the requirements of the law, your notice needs to include all of the following information:
- Identification of your intellectual property that you claim has been infringed upon on our Marketplace (if your notice pertains to the use of your trademark, please include your federal trademark registration number);
- Identification of the material that you claim has infringed on your intellectual property, including an explanation of how the material identified is using your intellectual property in a way that constitutes infringement, AND a description of where the material you've identified is located on the Marketplace (a URL of the product page is best);
- Your contact information, including your full name, mailing address, telephone number, and email address;
- Statement by you, stating that you have a good faith belief that the disputed use of the work is not authorized by the intellectual property owner, its agents, or the law;
- Statement by you stating that, under penalty of perjury, the information provided in your notice is accurate and that you are the intellectual property owner or are authorized to act on behalf of the owner;
- Electronic or physical signature of the person authorized to act on behalf of the copyright holder.
Important: Under Section 512(f) of the Digital Millennium Copyright Act, any person who knowingly misrepresents that content or activity is infringing may be subject to liability for damages, including attorney's fees.
What Happens After You Submit Your Notice?
Trademark Notice: If your Notice of Trademark Infringement contains all of the required information, we'll consider your request and take what action we believe in good faith to be appropriate.
Copyright Notice: We'll review your Notice of Copyright Infringement to make sure it contains all of the required information. If your notice is complete:
- We will remove or disable access to the allegedly infringing content expeditiously;
- We will notify the Seller who posted the content that it has been removed;
- We will provide the Seller with information about how to submit a counter-notice if they believe the content was removed in error.
Counter-Notice Process
If you are a Seller whose content has been removed due to a copyright infringement notice and you believe your content was removed in error or that you have authorization to use the content, you may submit a counter-notice.
Your counter-notice must include all of the following:
- Identification of the material that was removed and the location where it appeared before it was removed (a URL is best);
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification;
- Your name, address, and telephone number;
- A statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or if you are outside the United States, the jurisdiction of the United States District Court for the District of Maryland), and that you will accept service of process from the person who provided the original infringement notice;
- Your physical or electronic signature.
Upon receipt of a valid counter-notice, we will forward it to the original complainant. If the complainant does not notify us within 10-14 business days that they have filed a court action seeking to restrain your use of the content, we may restore the removed material.
Repeat Infringer Policy
In accordance with the DMCA and other applicable laws, we have adopted a policy of terminating, in appropriate circumstances, the accounts of Sellers who are deemed to be repeat infringers. We may also, at our sole discretion, limit access to the Marketplace and/or terminate the accounts of any Sellers who infringe any intellectual property rights of others, whether or not there is any repeat infringement.
